Welcome Rewards™ Terms and Conditions effective as of 06/23/2022

The Welcome Rewards program (“Program”) is a U.S. based loyalty program brought to you by Bed Bath & Beyond®, Inc., buybuy BABY® and Harmon® Face Values® (collectively, “Bed Bath” or “the Company”). These terms govern participation in the Welcome Rewards™ Program, including the paid Welcome Rewards™+ Program and Program members who participate as holders of the Welcome Rewards™ Mastercard® Credit Card and Welcome Rewards™ Store Credit Card.

These terms contain a mandatory arbitration provision that, as set forth in section 10 entitled “arbitration agreement & waiver of certain rights” below, requires you to arbitrate claims you may have against the company on an individual basis, meaning you cannot bring claims against the company in court, and confirms your agreement to a class action waiver in arbitration. It affects your legal rights. Please read it carefully.

These Terms and Conditions May Change

The Company has sole discretion to modify, add, or delete all or any portion of the Program rules, terms, conditions, benefits, at any time, with or without notice, even though such changes may affect the value of points already accumulated, the value of the rewards and/or the time of redemption. The Company may also terminate any individual’s membership, reduce any individual’s point totals, or declare any rewards forfeited for attempted violation of these Terms, attempted fraudulent activity, commercial or resale activity, or any other reason deemed justified in the Company’s sole discretion.

Eligibility & Enrollment

You can create a Welcome Rewards or Welcome Rewards+ membership account at any Bed Bath & Beyond, buybuy BABY, or Hamon Face Values store, online at www.bedbathandbeyond.com, www.buybuybaby.com, www.harmonfacevalues.com, or via a Bed Bath & Beyond, buybuy BABY, or Harmon Face Values app.    

Enrollment in the Welcome Rewards Program is free; no purchase is necessary. Participating brands include Bed Bath & Beyond, buybuy BABY, and Harmon Face Values. The Program is open only to residents of the United States, the District of Columbia, and Puerto Rico, who are 18 years or older.  To register for a Program Account, you must provide a valid email address and phone number. To redeem any Rewards, you must complete your member profile online by also providing your first and last name.

Enrollment in the Welcome Rewards+ Program, charges an annual $29 fee and is automatically renewed each year. Program is not available to residents of Alaska, Hawaii, or Puerto Rico.  All Welcome Rewards+ members are also members of the Welcome Rewards Program.     

By creating a Welcome Rewards and Welcome Rewards+ account, you are agreeing to receive e-mail messages related to the Program from our brands. Members who have opted out of receiving marketing emails from a brand will still be able to participate in the Program and receive messages about their Program Account (e.g., Rewards, birthday benefit, and news about changes to these Program Terms). The Company is not responsible for communications, offers, or rewards sent to out-of-date or changed email addresses.  

There is a limit of one Program Account per individual, email address, and phone number. Employees of the Company and their families are eligible to register for a Program Account.  

You agree not to sell, transfer, or assign your Program Account or any membership rights. Points, benefits, and Rewards are not your personal property, are not descendible, and may not be inherited, bartered, purchased, or sold. For online users, you are responsible for maintaining the confidentiality of any login credentials and for restricting access to your computer (or other device, as applicable) so that others may not access your Program Account. Business resellers are not eligible for the Welcome Rewards, Welcome Rewards+ or Welcome Rewards Credit Card program and will be blacklisted upon sign up. 

Membership Tiers & Benefits

Welcome Rewards

Welcome Rewards Members are eligible to earn 10 points per dollar for each eligible purchase made at a store, website, or app of the company. A Welcome Rewards Member will remain in the Program indefinitely unless membership is frozen or blacklisted for fraudulent activity.  

Welcome Rewards+

Welcome Rewards+ is a $29 yearly membership that provides members with the following additional benefits during their membership term:  

  • 15% off ENTIRE purchase for every purchase made in our stores, websites, and apps (subject to exclusions below).  
  • 5% in points on your entire purchase, also referred to as 50 points per $1 before coupon, after tax and shipping for every purchase made at the Company store, website, or app.  
  • FREE standard shipping with online purchases of most items (subject to exclusions below).
  • FREE Same Day Delivery 4x a year

We may, in our sole and absolute discretion, change the membership fee or benefits. If the membership fee changes, your membership will be valid for the remainder of your Membership Term at the original membership fee. At the conclusion of your Membership Term, the Membership Term will automatically renew at the new membership fee. 

All credit cards and debit cards accepted by the Company can be used to pay for your membership. If the card we have on file for you is declined for payment of your Membership Fee, you must provide to us a new card promptly or your Welcome Rewards+ Membership will be canceled. If you provide us with a new card that is successfully charged, your Membership Term will be based on the original sign-up date and not the date of the successful charge. If you received your Welcome Rewards+ Membership as a gift, please provide us your credit card or debit card through your Program Account at www.bedbathandbeyond.com/store/account, www.harmonfacevalues.com/store/account, www.buybuybaby.com/store/account.

UNLESS you notify us before we charge your membership fee that you do not want to auto renew, you understand that your Welcome Rewards+ membership will AUTOMATICALLY CONTINUE and you authorize us (without notice to you, unless required by applicable law) to collect the then current membership fee (currently US $29, but subject to change) and any taxes using any credit or debit card we have on record for you. New Jersey memberships will automatically renew without further notice.

We and our third-party payment service providers may request and receive from your payment card issuer updated payment card information, including updated payment card numbers or expiration dates. If we or our third-party payment service providers receive updated information, we may use that information to process payment for your applicable membership renewal fee. Your payment card issuer may allow you to opt out of this service. Please contact your payment card issuer for more information.

If you allow your membership to expire and then re-enroll in the membership program more than 60 days later, your membership fee will be the current membership fee for new members.

Earning

Members are eligible to earn Points every time they shop at the Company, whether in store, online, or via the Company apps. To earn Points, Program Members must identify themselves at the time of purchase, either in store, or online, by entering the same phone number or email address that was used to enroll. If you do not identify yourself as a Program Member at time of purchase, you will not accrue Points for that purchase. You may, however, add purchases to your Account within seven days of original transactions by logging into your Program Account at www.bedbathandbeyond.com/store/account/Login, www.buybuybaby.com/store/account/Login, or www.harmonfacevalues.com/store/account/Login and providing sufficient information to identify the purchase. The Company has sole discretion in determining whether a subsequently reported purchase qualifies for Points. Periodically, the Company may run promotions through which Program Members can earn additional Points.  

Points cannot be earned on purchases made using gift cards or merchandise cards as tender. Points are earned once a purchase has been shipped or a customer takes possession (i.e., In-store transactions) of order. Points are pending until the return period for the purchase has passed (typically, 30 days from date of shipment or in-store purchase), after which the Points are redeemable.

Current Bed Bath & Beyond, buybuy BABY and Harmon Face Values account holders can participate in the Welcome Rewards and Welcome Rewards+ Program by accepting these Terms and Conditions and enrolling in the Welcome Rewards Program.

Current Beyond+ members may participate in the Welcome Rewards Program or migrate to Welcome Rewards+ Program by accepting these Terms and Conditions.   

Credit Card Holders using an applicable Company credit card at the time of purchase will earn 60 points per $1 dollar spent on qualified purchases made in store, on our websites or apps. Credit Card Holders can stack points with qualified purchases when they are also Welcome Rewards Members or Welcome Rewards+ Members.   

Purchases of third-party gift cards, warranties, My Rewards, and services such as assembly, delivery, warranties, Portrait services, discounts applied to an order as a promotion are not eligible to earn Points; neither are taxes and shipping.       

Exclusions

Tender types excluded from earning points include but are not limited to - use of store/merchandise credit, temporary and permanent My Rewards, (e.g., ship or swap, diaper funds), corporate credit accounts, purchase of Welcome Rewards+ or gift certificates.    

Welcome Rewards and Welcome Rewards+ Programs cannot be combined with order level coupons, savings certificate, exclusive offer (including clearance), price match or other discounts. Not valid for purchase of home and furniture services, shipping, delivery, or gift cards. Not valid for wholesale, commercial, resale, or fraudulent purchases. The Company has sole discretion to determine whether a given purchase is wholesale, commercial, resale or fraudulent. The Company may in its sole discretion terminate the membership of any member that the Company determines bto be engaging in wholesale, commercial, resale or fraudulent activity.

Additionally, certain items are excluded from the Program. For a current list of products exempted from earning Welcome Rewards, please see exclusion list below.   Purchases made prior to June 7th, 2022, are not eligible. Bed Bath & Beyond, buybuy BABY and Harmon Face Values reserves the right to add additional exclusions at any time as needed.   

Not valid for wholesale or resale purchases, exclusive offers (including clearance), or final sale. Points are not available for purchases of delivery or installation fees, clearance or final sale items, or any other product or service designated by the Company as ineligible for these benefits.

Free Shipping Exclusions

Welcome Rewards+ Program will include Free Standard Shipping with online purchase of most items. This excludes Basket Items. Shipping surcharges on over-sized or extremely heavy items will still apply. These charges are indicated on the appropriate product information pages and will be displayed in the shipping subtotal of your order. Orders typically arrive within three to seven business days. Items shipped directly from the vendor or to Alaska and Hawaii have longer delivery lead times. This offer does not apply to products shipping to Puerto Rico or to Business Direct orders.     

Free standard shipping is not available on products that are not covered by standard shipping, cannot be shipped for legal or logistical reasons, require installation, or other products designated by the Company as ineligible for these benefits.

Rewards

Program Points can be used on eligible purchases, following their conversion to My Rewards. Points are issued in the form of My Rewards after meeting a 5,000-point threshold. Members can access their account activity from their Program account dashboard.

My Rewards can be used in any denomination greater than one dollar and on multiple purchases, across the Company, in store, websites or apps, until points are used in full or until points expire.

Points thresholds and My Rewards dollar conversions are as follows:

5,000 points = $5 My Rewards

10,000 points = $10 My Rewards

20,000 points = $20 My Rewards  

Points and My Rewards are non-transferable, have no cash value, are not legal tender, and do not give rise to any property or other interest whatsoever.

Processing of Points

Points accumulated through eligible purchases will be processed and awarded to Program Member’s account after the return period for that purchase has passed, typically 30 days after purchase. Other Points, such as those given for enrolment, birthday or appeasements are awarded within three days.  

Expiration of Points

If not redeemed, Points will expire 365 days +1 day from the date the points are earned. The expiration date will be extended by one year when a Member makes another transaction during the 365 days. The Company reserves the right to update Points expiration rules at any time as needed. Promotional Points or My Rewards awarded may expire sooner than one year.

Returns

If you return merchandise purchased with My Rewards, the dollar value of the My Rewards will be converted to a merchandise credit. Members who purchase receipted registry items that are returned will not get points deducted.     

Points earned from a purchase that is then the subject of a return, refund, returned check due to non-sufficient funds, or other credit will be deducted from the Member’s account in an amount equal to the Points earned for the original transaction, including bonus points.     

Cancellation and Closure of Account

Welcome Rewards+ Members have the right to not renew their program enrollment at any time by logging into your My Account dashboard and turning off auto renew. The enrollment fee is non-refundable and Welcome Rewards+ members will continue to enjoy the Program for the duration of their Membership Term. Welcome Rewards+ Members that do not renew their Welcome Rewards+ account remain Welcome Rewards Members.      

Welcome Rewards Members have the right to cancel their membership at any time. All Points are forfeited upon cancellation and former members cannot earn points; they must create a new Welcome Rewards account to receive Welcome Rewards program benefits.

Upon cancellation, former members cannot earn or redeem Points; they must create a new Welcome Rewards account to receive Welcome Rewards program benefits.

Opt-In/Privacy

By providing your enrollment information, you are opting in to the “Welcome Rewards” and “Welcome Rewards+” Program and communications, including email and social postings, as well as email communications from Bed Bath. You are also giving permission to the Program to use your transaction and profile data to send personalized Program communication and exclusive offers.  

Your information will be used in accordance with The Company’ Privacy Policy. 

Notice of Financial Incentive

In connection with the “Welcome Rewards” and “Welcome Rewards+” Program , we may offer financial incentives and/or price or service differences (“Incentives”) to members based on points earned as further described in these Terms, in exchange for our use of your personal information.

To offer these Incentives, we must track the personal information you provide when you sign up or engage in activities to earn Points, such as purchase history, date of birth, participation in events, and engagement with Company as described in these Terms (“Program Data”).

The value of Program Data is calculated by determining the approximate additional spending per member, per year compared to individuals who are not yet enrolled. The value of Program Data is related to the costs associated with offering the Incentives. You can withdraw from or cancel your membership at any time as set forth below in these Terms.

Member Communications Details – Opt In/Out

You may view your Program activity by logging-in to your Program Account and viewing your profile, or by contacting customer care. (See details below for contact information). A current, valid email address Is required for a member to receive certain notices in the Program, including without limitation, information about certain Additional Earning Activities and when you have been issued a reward. 

Arbitration Agreement & Waiver of Certain Rights

You and the Company agree that, except as set forth below, we will resolve any disputes between us (including any disputes between you and any of our third-party agents) through binding and final individual arbitration instead of through court proceedings. You and the Company hereby waive any right to a jury trial or to class or collective treatment of any Claim (defined below). All controversies, claims, counterclaims, or other disputes arising between the Company and or you and a third-party agent our stores (a "Claim") will be resolved exclusively by final and binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association ("AAA Rules"). The arbitration will be heard and determined by a single arbitrator. The arbitrator's decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The parties agree that the arbitration proceedings will be kept confidential and that the existence of the proceeding and any element of it (including, without limitation, any pleadings, briefs or other documents submitted or exchanged and any testimony or other oral submissions and awards) will not be disclosed beyond the arbitration proceedings, except as may lawfully be required in judicial proceedings relating to the arbitration, by applicable disclosure rules and regulations of securities regulatory authorities or other governmental agencies, or as specifically permitted by state law. The Federal Arbitration Act and federal arbitration law apply to this agreement. However, the arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms and Conditions including, but not limited to, a claim that all or any part of these Terms and Conditions is void or voidable.

If you demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, the Company will pay as much of the administrative costs and arbitrator's fees required for the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate. This arbitration agreement does not preclude you or the Company from seeking action by federal, state, or local government agencies other than a court. You and the Company also have the right to bring qualifying claims in small claims court on an individual, non-class basis. In addition, you, and the Company retain the right to apply to any court of competent jurisdiction for provisional injunctive relief only, including pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Terms and Conditions, nor a waiver of the right to have disputes submitted to arbitration as provided in these Terms and Conditions.

Neither you nor the Company may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only your and/or the Company’s individual Claims. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated.

Right to Opt-Out of this Arbitration Agreement: You may opt out of this Arbitration Agreement within the first 30 days after you enroll in the Program. You may also opt out of this Arbitration Agreement within 30 days after we notify you regarding a material change to this Arbitration Agreement. You may opt out by sending an email to the Company at www.bedbath.com/help or by sending a letter to Bed Bath & Beyond Inc., Attn: Legal Department, 650 Liberty Avenue, Union, NJ 07083. You should include your printed name, mailing address, and the words “Reject Arbitration.”

If any provision of this Section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section shall continue in full force and effect. If for any reason a claim proceeds in court rather than in arbitration you and Bed Bath and Beyond Inc. each waive any right to a jury trial. No waiver of any provision of this Section of the Terms and Conditions will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver shall not waive or affect any other portion of these Terms and Conditions. The arbitrator may award in the arbitration the same damages or other relief available under applicable law, including injunctive and declaratory relief, as if the action were brought in court on an individual basis. Notwithstanding anything to the contrary in the foregoing or herein, the arbitrator may not issue a "public injunction" and any such "public injunction" may be awarded only by a federal or state court. If either party seeks a "public injunction," all other claims and prayers for relief must be adjudicated in arbitration first and any prayer or claim for a "public injunction" in federal or state court stayed until the arbitration is completed, after which the federal or state court can adjudicate the party's claim or prayer for "public injunctive relief." In doing so, the federal or state court is bound under principles of claim or issue preclusion by the decision of the arbitrator. This Section of the Terms and Conditions will survive the termination of your relationship with the Company.

This section limits certain rights, including the right to maintain a court action, the right to a jury trial, the right to participate in any form of class or representative claim, the right to engage in discovery except as provided in AAA rules, and the right to certain remedies and forms of relief. Other rights that you or the company would have in court also may not be available in arbitration.

Miscellaneous

Under no circumstances will Bed Bath and family of brands be held liable for any delay or failure in performance due in whole or in part to any acts of nature or other causes beyond our reasonable control. 

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, then that provision will be deemed severable from these Terms and Conditions and will not affect the enforceability of any other provisions. 

The failure by us to enforce any right or provision of these Terms and Conditions will not prevent us from enforcing such right or provision in the future.

We may assign our rights and obligations under these Terms and Conditions, including in connection with a merger, acquisition, sale of assets or equity, or by operation of law. 

Welcome Rewards™ Mastercard® Credit Card

Welcome Rewards™ Program Terms (“Program Terms”)  

[Important note: These program terms contain provisions that limit our liability to you, eliminate your right to a trial by jury, require you to resolve disputes with us on an individual basis and not as a part of any class or representative action, and through final and binding arbitration. Review the “Agreement to Arbitrate” section below.]     

Please read these Program Terms carefully for important information about your rights and obligations in the Welcome Rewards™ Program (“Program”). By participating in the Program, you agree to these Program Terms.     

The Program is provided by Bed Bath & Beyond Inc “Bed Bath & Beyond” and serviced by Comenity Capital Bank. Bed Bath & Beyond is solely responsible for Program operation and may withdraw the Program or change the terms of the Program at any time. The purpose of the Program is to reward customers for certain uses of their Welcome Rewards™ Mastercard® Credit Card (“Card .”) The Program Terms may be supplemented with additional terms, conditions, and disclosures, including but not limited to applicable terms related to any promotional offers provided to you for use with the Program.

You understand that once your credit card application is accepted, you are enrolled in both the Welcome Rewards™ and Welcome Rewards™ + Programs. Bed Bath & Beyond will pay the cost of your initial Welcome Rewards™ + membership, currently a $29 value. At the end of your initial membership year, you may cancel your membership through your online account. Your Welcome Rewards™ + membership will automatically renew if you do not cancel the automatic renewal before your membership year ends; excludes Vermont residents. If you do not cancel your membership, your account will automatically be charged the Welcome Rewards™ + annual membership fee, currently $29. Your Welcome Rewards™ + membership will continue to automatically renew every year unless or until you cancel it.

Current BEYOND+ members whose credit card application is accepted will be enrolled in the Welcome Rewards™ and Welcome Rewards™ + Programs. Your membership in BEYOND+ will automatically end.

General Information Welcome Rewards™ Mastercard® Credit Card

The Program allows you to earn Points on the dollars you spend, as described in the “Earning Points" section below, using your Welcome Rewards™ Mastercard® Account (your “Account”). You can then redeem Points for My Rewards.

These Program Terms are separate from your Welcome Rewards™ Mastercard® Credit Card Account Agreement (your “Account Agreement”), which governs the use of your Account. In the event of any conflict between these Program Terms and your Account Agreement, these Program Terms will control in any matter relating to the Program. By using your Account, you agree to be bound by these Program Terms.   

All information collected about you in connection with the Program is subject to Bed Bath & Beyond’s privacy policy, which can be obtained at  

Earning Points Welcome Rewards™ Mastercard® Credit Card

You will earn Points when you, or an authorized user, make eligible purchases of goods and services for personal, family, and household purposes using your Account, minus any returns, refunds, or credit adjustments (“Net Eligible Purchases”). Purchases that are not a whole dollar amount will be rounded to the nearest whole dollar amount to determine the amount of Reward Dollars earned. Purchases that end in $0.50 will be rounded using bankers rounding, where the purchase is rounded to the nearest even whole dollar amount. Example: $2.50 rounds to $2.00 whereas $3.50 rounds to $4.00.  

Using your Welcome Rewards™ Mastercard® credit card, you will earn:  

  • 100 Points for each $1.00 of Net Eligible Purchases made at: Bed Bath & Beyond, buybuy BABY, Harmon Face Values or at:  www.bedbathandbeyond.com www.buybuybaby.com www.harmonfacevalues.com  
  • 20 Points for each $1.00 of Net Eligible Purchases made at qualifying gas stations and grocery stores. *
  • 10 Points for each $1.00 of Net Eligible Purchases made everywhere else Mastercard is accepted. *

*Reward Merchant Classification Codes: Merchants who accept Visa/Mastercard are assigned a merchant classification code (“MCC”), which is determined by the merchant or its processor in accordance with Visa/Mastercard procedures based on the products and/or services they primarily sell. Comenity Capital Bank and Bed Bath & Beyond do not control the assignment of these codes and are not responsible for incorrectly coded purchases. Even though a merchant or some of the items it sells may appear to fit within a certain rewards category, the merchant may not have a code in that category. Purchases made with third-party payment accounts, including but not limited to PayPal and Venmo, will not earn additional Reward Dollars.  

Reward Dollars are not earned on returns, refunds, credit adjustments at Bed Bath & Beyond Inc., purchases using any type of promotional financing, unauthorized or fraudulent charges, charges that violate the terms of your Account Agreement, balance transfers, cash advances, transactions treated similar to cash advances, interest charges, and fees of any kind.

Bed Bath & Beyond may temporarily prohibit you from earning Points, using Points, receiving, or redeeming My Rewards, or using any features of the Program if: your Account becomes delinquent; Comenity Capital Bank suspects that you or any authorized user has engaged in fraudulent activity related to your Account or the Program; or Bed Bath & Beyond suspects that you misused the Program in any way.  

Points awarded for purchases that do not remain Net Eligible Purchases will be deducted from your Points balance. Returned items may result in credits being applied to your Account, which will reduce or may eliminate accumulated Points and may result in a negative Reward Point balance. If your Reward Point balance goes negative, you must first earn Points to bring your Points balance to zero before earning any Points eligible for redemption. Bed Bath & Beyond and Comenity Capital Bank reserve the right to verify and adjust Points, as applicable, at any time.  

Bonus Points for Special Offers Welcome Rewards™ Mastercard® Credit Card

Welcome Rewards™ + Program Terms (“Program Terms”)  

[Important note: These program terms contain provisions that limit our liability to you, eliminate your right to a trial by jury, require you to resolve disputes with us on an individual basis and not as a part of any class or representative action, and through final and binding arbitration. Review the “Agreement to Arbitrate” section below.]        

Please read these Program Terms carefully for important information about your rights and obligations in the Welcome Rewards™ + Program (“Program”). By participating in the Program, you agree to these Program Terms.     

The Program is provided by Bed Bath & Beyond Inc (“Bed Bath & Beyond”) and serviced by Comenity Capital Bank. Bed Bath & Beyond is solely responsible for Program operation and may withdraw the Program or change the terms of the Program at any time. The purpose of the Program is to reward customers for certain uses of their Welcome Rewards™ Store Credit Card (“Card.”) The Program Terms may be supplemented with additional terms, conditions, and disclosures, including but not limited to applicable terms related to any promotional offers provided to you for use with the Program.

You understand that once your credit card application is accepted, you are enrolled in both the Welcome Rewards™ and Welcome Rewards™ + Programs. Bed Bath & Beyond will pay the cost of your initial Welcome Rewards™ + membership, currently a $29 value. At the end of your initial membership year, you may cancel your membership through your online account. Your Welcome Rewards™ + membership will automatically renew if you do not cancel the automatic renewal before your membership year ends; excludes Vermont residents. If you do not cancel your membership, your account will automatically be charged the Welcome Rewards™ + annual membership fee, currently $29. Your Welcome Rewards™ + membership will continue to automatically renew every year unless or until you cancel it.

Current BEYOND+ members whose credit card application is accepted will be enrolled in the Welcome Rewards™ and Welcome Rewards™ + Programs. Your membership in BEYOND+ will automatically end.

General Information Welcome Rewards™ Store Credit Card

The Program allows you to earn Points (“Points”) on the Points you spend, as described in the “Earning Points” section below, using your Bed Bath & Beyond, buybuy BABY, or Harmon Face Values Credit Card Account (your “Account”). You can then redeem Points for Bed Bath & Beyond Reward Certificates.  

These Program Terms are separate from your Bed Bath & Beyond, buybuy BABY, or Harmon Face Values Credit Card Account Agreement (your “Account Agreement”), which governs the use of your Account. In the event of any conflict between these Program Terms and your Account Agreement, these Program Terms will control in any matter relating to the Program. By using your Account, you agree to be bound by these Program Terms.

Earning Points Welcome Rewards™ Store Credit Card

You will earn Points when you, or an authorized user, make eligible purchases of goods and services for personal, family and household purposes using your Account, minus any returns, refunds, or credit adjustments (“Net Eligible Purchases”). Purchases that are not a whole dollar amount will be rounded to the nearest whole dollar amount to determine the number of Points earned. Purchases that end in $0.50 will be rounded using bankers rounding, where the purchase is rounded to the nearest even whole dollar amount. Example: $2.50 rounds to $3.00 whereas $3.50 rounds to $4.00.  

Using your Bed Bath & Beyond, buybuy BABY, or Harmon Face Values Credit Card, you will earn:  

  • 100 Points for each $1.00 of Net Eligible Purchases made at: Bed Bath & Beyond, buybuy BABY, Harmon Face Values or at:  www.bedbathandbeyond.com www.buybuybaby.com www.harmonfacevalues.com  

Purchases made at Bed Bath & Beyond, buybuy BABY, and Harmon Face Values will earn 5% back in Points for each $1.00 spent using your Account.  

Points are not earned on returns, refunds, credit adjustments at Bed Bath & Beyond Inc., purchases using any type of promotional financing, unauthorized or fraudulent charges, charges that violate the terms of your Account Agreement, interest charges, and fees of any kind.

Bed Bath & Beyond may temporarily prohibit you from earning Points, using Points, receiving, or redeeming Reward Certificates, or using any features of the Program if: your Account becomes delinquent; Comenity Capital Bank suspects that you or any authorized user has engaged in fraudulent activity related to your Account or the Program; or Bed Bath & Beyond suspects that you misused the Program in any way.  

Points awarded for purchases that do not remain Net Eligible Purchases will be deducted from your Points balance. Returned items may result in credits being applied to your Account, which will reduce or may eliminate accumulated Points and may result in a negative Points balance. If your Points balance goes negative, you must first earn Points to bring your Points balance to zero before earning any Points eligible for redemption. Bed Bath & Beyond and Comenity Capital Bank reserve the right to verify and adjust Points, as applicable, at any time.

Bonus Points for Special Offers Welcome Rewards™ Store Credit Card     

From time to time, Bed Bath & Beyond and family of brands may make bonus offers to earn additional Points (“Bonus Points”). Read each offer carefully, as there may be additional important conditions or limitations, such as blackout periods, Bonus Points limits, or exclusions. You may have to register to qualify for the offer. Bed Bath & Beyond may change or withdraw an offer at any time without notice. Any such change or withdrawal will not affect Bonus Points already earned. Certain offers may only be communicated via email.

Expiration

Important note: Points will expire 365 +1 day after the date that they are posted to your Reward Point balance with no additional activity in those 365 days.  With activity (purchase made in store or online using your credit card or earning points in the base Loyalty program; your points will be extended for an additional 365 days     

My Rewards expire 90 days from the date they are issued. Rewards are given in increments of $5.00.  

Termination and Forfeiture

Important note: Subject to any requirements or limitations of applicable law, Bed Bath & Beyond may at any time for any reason change or terminate the Program and these Program Terms without notice.  

Bed Bath & Beyond reserves the right to terminate you from the Program. If the Program terminates, Bed Bath & Beyond terminates you from participating in the Program, or you voluntarily cancel enrollment in the Program, all Points will be forfeited.  

Points will be forfeited if any of the following occur: your Account is closed; you terminate your participation in the Program; you or any authorized user engages in any fraudulent activity or misuse related to your Account or the Program or engage in any activity deemed to be abusive or gaming conduct, as determined by Bed Bath & Beyond. Misuse includes, but is not limited to, obtaining, or using an Account to maximize Points earned in a manner that is not consistent with typical consumer activity as determined in Bed Bath & Beyond’s sole discretion.

Issuing Rewards and Redemptions

For every 5,000 Points you earn, you will receive a $5.00 My Rewards. My Rewards will be issued in increments of $5.00, with a minimum amount of $5.00 and a maximum of $250.00. See My Rewards Redemption Terms & Condition for further information.   

You will receive your My Rewards in your Loyalty Account, www.buybuybaby.com/store/account, www.bedbathandbeyond.com/store/account, www.harmonfacevalues.com/store/account within 30 days of purchase.      

Other Terms

Points may not be sold, transferred, or altered in any way by you. Points you earn may not be combined with Points earned on any other credit account or earned by anyone else (other than your Authorized User).  

Points and My Rewards have no cash value and are purely for promotional purposes. My Rewards may not be used as payment for any outstanding obligations to the Bank or its affiliates.     

You may review your Points balance via www.bedbathandbeyond.com/myaccount, www.buybuybaby.com/myaccount, and www.harmonfacevalues.com/myaccount. It may take up to two billing cycles for Points to post for promotional events. The number of Points earned is based on the date your purchase was made, which may be different than the date the transaction posts Welcome Rewards Account. For mail order, special order, online, and other purchases, your transaction may not post to your Account until items have shipped.  

Communications and Customer Service

Bed Bath & Beyond and Comenity Capital Bank may send communications regarding the Program by mail, phone, email, or other methods, including through online Account Center or mobile app. By providing your mobile phone number and email address, Welcome Rewards may contact you about all of your accounts and this Program.

If you do not notify Bed Bath & Beyond within that period, you waive your right to make a Reward Dollars dispute with respect to that purchase. Bed Bath & Beyond may require you to provide written confirmation of the dispute and the applicable purchase receipt and may decline to investigate further if you do not provide the requested confirmation or a valid receipt. Upon completion of the investigation, Bed Bath & Beyond will have no further responsibilities if you later reassert the same Reward Dollars Dispute.

   Limited Liability

Unless otherwise required by law, neither Bed Bath & Beyond nor the Bank, nor any of our or its affiliates, officers, directors, employees, service providers, or agents will be liable to you, or anyone making a claim on your behalf, in connection with the Program or these Program Terms, including but not limited to, use of the Program and any redemption for or purchase of products or services through the Program.     

Important note: Notwithstanding the foregoing, any liability that Bed Bath & Beyond may have to you in connection with the Program shall be limited to the amount of any Reward Dollars you have earned in accordance with these Program Terms.     

No Warrantees

Bed Bath & Beyond, the Bank, and all of each of such company’s respective subsidiaries and affiliates make no warranty, express or implied, including but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Program or any products or services related to such Program.  

Taxes

You are responsible for any tax liability that may result from participation in the Program or use of any Rewards Certificate. Consult your tax advisor concerning such tax consequences.     

Cancelling Program Participation

You may cancel your participation in the Program at any time by calling us at:

Governing Law; Assignment

The Program and these Program Terms are governed by federal law and, to the extent state law applies, the laws of the State of Utah. You may not assign your rights or obligations under these Program Terms to any other person or entity. Important note: You and Bed Bath & Beyond agree that each of us may bring claims arising from or relating to these program terms only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding.  

“Claim,” as used in these Program Terms means any claim, dispute, or controversy that in any way arises from or relates to these Program Terms.

Complete Agreement; Severability; Conflicts; No Waiver     

These Program Terms supersede any previous terms and conditions governing the Program. The Program is not available where and to the extent prohibited by law. If any part of these Program Terms conflict with applicable law, that provision will be deemed severed from these Program Terms and the remainder of the Program Terms will remain in effect. Bed Bath & Beyond will not lose our rights under these Program Terms because Bed Bath & Beyond chooses to delay or not enforce them.   

Agreement to Arbitrate

Important note: Any party may elect to arbitrate any claim arising from or relating to these program terms (including disputes about the validity, scope, or enforceability of this agreement to arbitration), in which case such claim shall be settled by binding arbitration on an individual basis and not as part of any class or representative action.

Arbitration may be elected by any party with respect to any such Claim, even if that party has already initiated a lawsuit with respect to a different Claim. Bed Bath & Beyond will not demand to arbitrate an individual Claim that you bring against us in small claims court or your state’s equivalent court, if any. But if that Claim is transferred, removed, or appealed to a different court, Bed Bath & Beyond then has the right to demand arbitration.

The arbitration will be conducted by the American Arbitration Association ("AAA"), JAMS, or any other company selected by mutual agreement of the parties (the “Administrator”), in accordance with the rules of the Administrator. Payment of all filing, administration and arbitrator fees will be governed by the Administrator’s rules. If, however, you can demonstrate that the costs of arbitration will be cost-prohibitive for you as compared to the costs of litigation, Bed Bath & Beyond will pay as much of the filing, administration and arbitrator fees as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive for you. The arbitrator will not have the power to award punitive or exemplary damages, the right to which each party hereby waives. The arbitrator’s decision must be with written explanation and remain confidential. For purposes of this “Agreement to Arbitrate” section, these Program Terms are governed by the Federal Arbitration Act, 9 U.S.C. sec. 1-16 (FAA).   

Opt-Out Procedures: You may choose to opt-out of this Agreement to Arbitrate by sending a written notice within 30 days after the date you accept these Program Terms for the first time. You may send your opt-out notice by mail or hand delivery to 650 LIBERTY AVENUE, Union, New Jersey 07083. Your opt-out notice must include your full name and clearly indicate your intent to opt-out of the arbitration provisions.

Prior to initiating any arbitration, the initiating party will give the other party at least 60 days' advanced written notice of its intent to file for arbitration. Bed Bath & Beyond will provide such notice by mail or email using the contact information on file with us and you must provide such notice by mail to us at 650 LIBERTY AVENUE, Union, New Jersey 07083.
